The Board of Perry Township Trustees met in Regular Session on Monday, July 13, 2009 at 7:00 p.m. at the Community Room in East Liberty.  Roll Call: Merle Ackley, present, Jeff Rosebrook, present, Gary Baker, present and Cindy Stalling, present.  Also present was Melony Baker, Howie Kaiser, Keith Montgomery, Beverly Wolf, Linda Baldridge, John Brose, Bonnie Brose, Dave Cook, Kurt Penhorwood, Margie Cook, Tom Cunningham, Mike Yoder and Paul Blair.

           The minutes of the previous meeting was given to the Trustees to read prior to this meeting.  Mr. Ackley asked if there were any additions or corrections to the minutes and the stand approved.  Ackley, yes, Rosebrook, yes, and Baker, yes.

           Mr. Ackley asked if there were any additions or corrections to the financial statements that were given to the Trustees from the fiscal officer.  They stand approved.

 Ackley, yes, Rosebrook, yes and Baker, yes.

     Mrs. Bev Wolf needs the firemens help tomorrow at the food pantry around 12:30 p.m.

     Mrs. Wolf wanted to know what the update on the Akey Cemetery is?  Did we send Barb Akey a letter about this yet?  Mr. Merle Ackley told her that he has talked to a gentleman and was told that the tombstones are piled in a ditch on the property.  Log. Co. Prosector, Mr. Heaton emailed Mrs. Stalling and said that he would have everything ready in two weeks. Mrs. Wolf said that she thinks the trustees should go out and find the cemetery, so they know exactly where it is at. 

     Mrs. Bonnie Brose thanked everyone for their help on July 4th celebration.   PTEC did real good, they made more money this year than they did last year.

     Bonnie reported that there was a man in the library earlier today and she called one of the firemen up from the fire station as the man was shady.  Scott Harris came up to the library with her and she thanked him for doing that for her.  The man left after Scott came up to the library.

      Mr. Kurt Penhorwood reported that the fireworks were really good, he had a lot of family in and they all stated that they would be back next year to see them again.

     Mrs. Margie Cook wanted to know if we could fog for the mosquitoes later in the evening as sometimes on Friday evenings she has her grandchildren staying all night and they like to go out and chase lightning bugs and can’t do that when we are fogging.  Mr. Ackley told her that we are going to move the fogging to Tuesday and Thursday evenings.

     Chief Keith Montgomery reported that there has been 35 fire runs, 46 EMS runs for a total of 81 so far for 2009.

      On June 10 the fire dept. had their ladder check, and all were okay.

     The air packs will be done the last week of July and they will be all checked out and ready for service.

     The fire dept. wants to get with the trustees and put together a new hiring and firing procedure.

     The County is starting a RIP (rapid intervention team) team it will have 3 members from each department from the county on it and will do countywide coverage.  Chief wanted to know if our insurance will cover our equipment of something happens to it while on one of these runs.   Mrs. Stalling will check this out for the Chief.

     Mr. Gary Baker reported that the electric fence on Terri Snapps property beside Perry Park has been removed.

     Mr. Baker reported some of the things that were done at Perry Park prior to the celebration down there:

1)      the fence over the creek is back up

2)      the old playground equipment has been removed.

3)      Roofs over the shelter house and the concession stand have been painted.

4)      Lights at the shelter house has been fixed.

5)      All the wells have passed the Log. Co. Health Depts. Test

6)      Moved 2 picnic tables over to the playground area.

7)      The split rail fence has been completed. ( with the help of Mrs. Baker)

 

 

Mr. Baker also reported that the siren at the fire house has been fixed as well.

 

     Mrs. Margie Cook wanted to know if the hole in her back yard that she brought  up to the Trustees last year, needs to be dug up or not?  The trustees aren’t sure and they will check this out. 

    

     Mr. Baker reported that he talked to Mr. Harvey Grimes of the County about a  company called DJL Materials from Cuyahoga Falls about crack fill for the roads.  Mr. Grimes told Mr. Baker that this company will let you use their equipment if you purchase the material from them.  This is the company that the county uses.  They use federally approved material.  Mr. Grimes stated that this company is under the State Bid, and also has a 50% savings over contracting it out.  And this way we wouldn’t have to put it out for bid. 

      Mr. Jeff Rosebrook reported that there is an outlet in the newer shelter house at the park that needs fixed.   He stated that the squirrels are eating the wiring at the old shelter house, and it needs to be repaired.  Mr. Rosebrook stated that he will get some prices on material to fix the problem and he will do the work himself.

      Mr. Rosebrook got the tree at the intersection of SR 292 and CR 2 trimmed.

      Mr. Rosebrook has run the roads and he stated that TR 141 is the in the worse shape for crack sealing. 

      Mr. Rosebrook reported that he got a complaint about the overflow at the old gas station running into McMurrough’s yard.  Jeff stated that he will look into this problem.

     Mr. Merle Ackley thanked Jeff and Gary for all the work they have been doing and for taking care of the old playground equipment at the park.

      Mr. Tom  Cunningham said that there is an old farmhouse behind their home, and it has become a home to lots of wildlife.  Mr. Cunningham stated that there has been some kids back there on 4-wheelers, and he wanted to know if the fire dept. could use this house as a practice place to burn?  Chief Montgomery stated that they could do it, but there would have to be permission papers signed by the property owners giving the fire dept. the right to do it, and not be responsible.   The trustees will see what they can do about this.

     Mr. Merle Ackley moved the following Resolution:

 

      WHEREAS the Township of Perry requests the Logan County Auditor to prepare a Certificate of Estimated Property Tax Revenue to be generated for an Renewal levy in the amount of 4.00 mills which is levied for the purpose of Fire Protection pursuant to Ohio Revised Code section 5705.19 (I) to be placed on the ballot for the general election to be held on the 3rd day of November, 2009 and to be collected beginning with tax year 2009 which is calendar year 2010.

       NOW THEREFORE BE IT RESOLVED, by the Township of Perry that the Logan County Auditor is hereby requested to present said certificate at this earliest convenience.

      Mr. Gary Baker seconded by Resolution and the roll being called upon its adoption the vote resulted as follows:

     Mr. Merle Ackley moved the following Resolution:

     NOW THEREFORE BE IT RESOLVED, by the Township of Perry that the Logan County Auditor is hereby requested to present said certificate at his earliest convenience.

     Mr. Gary Baker seconded by Resolution and the roll being called upon its adoption the vote resulted as follows:

     Mr. Mike Yoder, the Log. Co. Auditor, was there to discuss our 3 levies that are up this year.  The trustees stated that we do not want to renew the park or the cemetery levies.  We do want to renew the fire levy and add another current expense levy.  

    Mr. Yoder had the Certificate of Estimated Property Tax Revenue for each of the levies that we want to put on the ballot. 

The fire 4.00 mill levy will generate $450,000.00 per year

The 1.00 current expense levy will generate $62,000.00 per year.

Trustees signed the proper paperwork and Mrs. Stalling will get the paperwork done and turned into the Log. Co. Board of Elections.

     Mrs. Stalling reported that Mr. Lance Emberling and Mr. Clayton Spring of the fire  dept. officially resigned as of today, July 13, 2009.  All trustees agreed to pay them for the days that they had signed up for to work and were not allowed to work because of them not taking the 12 lead class. 

     Mr. Gary Baker reported that he had gotten a quote for the material for the hand railing for the walk to the restrooms at the park.  It is going to cost $300.00  and Mr. Baker will install it. Mr. Merle Ackley made a motion for said purchase, seconded by Mr. Jeff Rosebrook. Ackley, yes, Rosebrook, yes and Baker, yes.

      Mr. Baker talked to Dave James of Heiby Oil and we can pre-buy our propane right now for $145.9 per gallon.  We have a carry over of 3473 gallons.  Mr. Baker made a motion to use the carry over for the Lodge Hall and to purchase 6000 gallons for the Fire Dept and the

Temperance St.
garage, seconded by Mr. Jeff Rosebrook..  Ackley, yes, Rosebrook, yes and Baker, yes.  Mr. Baker will contact Heiby Oil.

     Mr. Jeff Rosebrook meet with Fire Chief Montgomery about the lot beside the fire house. Jeff would like for the other two trustees to look at it, the section that is mowed, to go as wide as the mowing and to the back corner of the fire house.  After it is agreed upon as to the size of the lot, then Mr. Rosebrook will start digging on it.

      Mr. Rosebrook attended another Chicken Farm meeting.  The committee is still fighting to keep them out of Liberty Township, and Mrs. Stalling reported that she received paperwork from a lawyer from Dayton that wanted the minutes from 1-1-08 to present.  This was associated with the Hi-Q Egg Co.

     Mrs. Stalling brought up that Mrs. Patty Clark brought a check for Joe Clarks squad run. Mrs. Stalling stated that we had already been paid by Medicare for the run.  All trustees agreed to reimburse Mrs. Clark for the additional money as they are Perry Township residents.

      Mr. Merle Ackley made a motion to pay the bills, seconded by Mr. Jeff Rosebrook. Ackley, yes, Rosebrook, yes and Baker, yes.
