The Board of Perry Township Trustees met in Regular Session on Monday, October 10, 2011 at 7:00 p.m. at the Community Room in East Liberty.  Roll Call: Jeff Rosebrook, present, Merle Ackley, present, John Brose, present and Cindy Stalling, present.  Also present was: Bonnie Brose, Terry Riley, Kurt Penhorwood, Jenn Bowman, Dave Cook, Keith Montgomery, Pup McColloch, Kane Gibson, Dan Ackley, Ann Beck, Sandy Wilcox, Jessica Gibson and Kaylee Gibson.
      Chairman Rosebrook called the meeting to order. 
     The minutes of the previous meeting was given to the Trustees to read prior to this meeting.  Mr. Rosebrook asked if there were any additions or corrections to the minutes and then asked if there were any additions or corrections to the financial statements that were given to the Trustees by the Fiscal Officer.  They stand approved.  
     Mr. Terry Riley, brought up about some ditch problems on his Property on C.R. 142.  He said that there is 15" tile about 2 miles long that goes through his property and on to the chicken farm.  There is some problems there, and he has talked to the neighbor there, Mr. Jake Coil and can't get anywhere with Mr. Coil about this problem.  Mr. Riley stated that the Chicken Farm purchased $1,100.00 worth of tile for this problem and it has been sitting back on the land for about 3 years.  Mr. Riley would like for the Trustees to go out and talk to Mr. Coil and see if they can get him to do something about this problem.  Mr. Riley said that about 90' needs repaired, and that 90' goes through some lawyers property, Coil's property, Riley's property, the old Stahl's property and the Chicken Farm's property.  Trustees told him that they would go over and talk to Mr. Coil and see if they can get anywhere with him. 
     Mr. Kurt Penhorwood had a bid for the seal coating on the Park and the Fire Dept. parking lot.  For both projects it would be $5,635.00.  Mr. Merle Ackley made a motion to accept this bid from Mr. Penhorwood, seconded by Mr. Jeff Rosebrook.  Rosebrook, yes, Ackley, yes and Brose, yes. 
     Mr. Penhorwood stated that it is time for service on the crack-fill machine.  The first maintenance was to be done at 50 hrs. and we are now at 128 hrs. on the machine.  Kurt took the machine back to the company twice to have some work done on it. And then when Kurt got it back he re-wired the machine.  That took him 5 hrs to do this.  Mr. Penhorwood said that he can do the servicing of the machine.  For a filter for it would cost $350.00 and it would take a week to get it in. Also he can get the oil needed for the machine at NAPA.   Kurt stated that the next service of the machine should be done at 250 hrs.  Mr. Jeff Rosebrook made a motion to let Mr. Penhorwood service the crack fill machine, seconded by Mr. Merle Ackley.  Rosebrook, yes, Ackley, yes and Brose, yes.  This bill will get divided 3 ways between the 3 townships owning the machine.     
     Mr. Penhorwood then brought up that the tile on his property on N. Main Street in the back yard is caving in.  It needs to have some fill put on top of it.  Trustees will look into this matter. 
     Mrs. Jenn Bowman invited everyone down to the fire house on Wednesday, Oct. 12 from 5-8 p.m. for the open house that they are hosting.  
     Mrs. Bowman reported that there is going to be a couple of lectures that she will be giving : 1) will be on Nov. 3 at 7:00 p.m. in the C.R. with Care Flight landing on the parking lot beside the fire house at 8:00 p.m.
2) On Nov. 29, she will be giving a lecture at the C.R. at 7:00 p.m. on Farm Trauma.
Everyone is invited to come to these two lectures. 
     Mrs. Bowman stated that the AED has been checked out and  we need some new pads for it.  We need 8 new sets and each set costs $18.50 for a total of $148.00.  We will then have an AED on every vehicle at the fire dept.  
     Mrs. Bowman said that they need a new battery for the portable suction unit.  From PMI the battery is $66.15.  Mr. Ackley made a motion for said purchase, seconded by Mr. Brose.  Rosebrook, yes, Ackley, yes and Brose, yes.   
     Chief Keith Montgomery, said that the fire dept. has 7 or 8 pairs of old boots that are not any good anymore and he would like for the township to donate them to the Log. Co. HazMat team.  All Trustees were in agreement to donate them to HazMAt.
     Chief stated that Jenn Bowman needs new turn out gear.  She has been wearing an old set and she needs one that fits her.  Mr. Merle Ackley made a motion for said purchase, seconded by Mr. Brose.  Rosebrook, yes, Ackley, yes and Brose, yes. 
     Chief reported that he received an email and  the County is not ready to change radios yet, maybe by the end of October or the first of November they will be ready.  
     Chief reported that Ken Rosebrook, Jr. got 3 of the fire trucks serviced and he has 2 more to go.  
     Mr. Dan Ackley, zoning inspector, reported that he contacted DP&L about the tower on T.R. 152, the gentleman that he talked to said that the Township was sent a letter to Mr. Ackley, which he never received, updating the sub-stations.  There is nothing we can do about the new tower.  Mr. Ackley stated that the gentleman was very nice and explained everything to him.   
     Mr. Dan Ackley then brought up about the zoning permit for Michael Young, he is the gentleman who got a permit and then called Dan and said he was going to use the building for agriculture.  Dan wanted to know how he can make Mr. Young come to a meeting, if no one else has ever come to a meeting.  Mr. Ackley hasn't talked to Mr. Young since our last meeting.  Mr. Rosebrook thinks he needs to prove he's using it for ag. purposes.  Dan had talked to Wes at LUC, and Wes said that you have to take their word for it.  Mr. Merle Ackley said that we should take Mr. Young's word for it.  Dan said that he will go back out and talk to Mr. Young again.  
     Mr. Dan Ackley got a phone call from a man who was interested in getting a conditional use permit for a business.  This man is living in the house on the property, but the mother-in-law owns the property.  The Mother-in-law doesn't want any business on her property.  Dan wanted to know if a conditional use permit goes to the property owner or the resident?  The trustees feel that it should go to the property owner, Dan said that that is what Wes, of LUC, said too.  
     Dave Cook, squad chief, reported that we will be getting a bill from Jones Ignition, as the FD got 6 O2 tanks filled today.  
     Mr. Cook, reported that Mr. Steve Henderson, has signed a waiver for the old house on his property to be used as a training project for the F.D.   The waiver states that the Township is not responsible in any way.  
     Ms. Ann Beck, candidate for Bellefontaine Municipal Court Judge,  passed out info to everyone in attendance and then gave an update on herself.  She gave an overview on herself and her life and stated that she would appreciate votes in the upcoming election. 
     Mr. Terry Riley wanted to know if we had applied for a grant for Ash Tree removal?  We told him we had not, he said that there is money out there for this.
     Mr. Merle Ackley reported that we need to advertise the removal of flowers from the graves at the Cemeteries.   All Trustees agreed to have them removed by Oct. 25, Cindy will advertise this in the Examiner.
     Eichholtz Funeral Home contacted Mr. Ackley about some work on the Garwood lot. 
     Mr. Ackley reported that the roads have been mowed.  
     Mr. John Brose turned in a paper on checking out the equipment at the playground at Perry Park.  
     Mr. Brose reported that the doors, locks, window at the ladies restroom have all been fixed.  
     Mr. Brose stated that he reported 2 street lights being out and they have been fixed.  
     Mr. Brose has the base order in the GreenLawn Cemetery done.  
     Mr. Brose said that the door on the front of the Community Room needs to be replaced.  
     Mr. Merle Ackley reported that Mr. Ralph Hall, our cemetery mower, is not satisfied with his bid for mowing the three cemeteries.  He feels like we cheated him, but he put in the bid not us.  
     Mr. Jeff Rosebrook reported that the tile on Bray's property has been fixed, he, John and Dave fixed it.  It took 60'of tile to fix it.   The tile on Krys Martin's property has been fixed too. 
     Mr. Rosebrook stated that he hasn't heard anything from the lady from DP&L (Miami Valley Lighting) about the street light in the alley of the Church of Christ.  
     Mr. Merle Ackley stated that the Insurance lady called him, and would like to put Mr. Ackley on a Medicare supplement plan.  This would save the township around $1,000.00.  She is supposed to be coming to our next township meeting to explain the changes for the next year in our insurance premiums.  
     Mr. Rosebrook will be contacting Del-Mar Tree service to do some work for us.  
      Mr. Rosebrook reported that HBI Electric got the lights up on the side of the fire house to light up the parking lot.  
     Mr. Jeff Rosebrook reported that when Ken Rosebrook was servicing the fire trucks, he told Jeff that the grass truck needs a new muffler, and a transmission pan gasket.  He stated that he can fix that when he services the other two trucks that he doesn't have done yet.  
      Mr. Rosebrook stated that we are out of stone at the shop and he would like to go and get another load, all trustees agreed to get another load of stone. 
     Mr. Rosebrook brought up about ordering the pea gravel for the playground at the park.    
     It was brought up about when to close the park?  It was agreed to close it on Oct. 28.  
     Trick-or-Treat will be on Oct. 27 from 6:00 p.m. - 7:30 p.m.
     Mr. Rosebrook will be getting some prices for new tires for the Bobcat and Mr. Brose said that it needs to be serviced too. 
     Mr. Ackley called Parrott's Implement about the missing invoices, and they told him that they would mail them to us.
     Mr. Rosebrook has the dumpsters ordered for fall dumpster day.  John Baughman will be taking the metal again at the dumpster day. 
     The county will be ordering the county stop signs on Dec. 1.  If we would like to go in with the county and order any of the new high reflective signs we need to let them know prior to Dec. 1.
     We received a letter from Haz-Mat asking each township for $300.00 for 2012 as their funds are getting low.  Chief reported that the fire dept. has called them a couple of times and we have some Haz Mat techs on the Fire Dept.  After some discussion, Mr. Jeff Rosebrook made a motion to give HazMat $150.00, seconded by Mr. Merle Ackley.  Rosebrook, yes, Ackley, yes, and Brose, yes. 
     Mr. Merle Ackley made a motion to accept the Amounts and Rates set by the County Auditor, seconded by Mr. Jeff Rosebrook.  Rosebrook, yes, Ackley, yes and Brose, yes. 
      Mr. Keith Montgomery said that his Mom has a picture that she would like to hang up in the Community Room, all Trustees said that it was fine.  Keith will bring it to our next meeting. 
      Mr. Jeff Rosebrook made a motion to pay the bills, seconded by Mr. Merle Ackley.  Rosebrook, yes, Ackley, yes and Brose, yes.
